Terms and conditions of use
These terms govern your use of wa91.com and the purchase of vehicles and services through it. Please read them carefully before placing an order. By using this website you accept these terms.
1. Who we are
wa91.com is operated by WA91, a trader in used cars and commercial vehicles for export from China. You can reach us at services@wa91.com.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts. If you order on behalf of a company, you confirm that you are authorised to bind that company.
3. Vehicle information
We describe every vehicle as accurately as possible, with photographs, video and, where available, an inspection report. Used vehicles are sold in their actual condition, with the mileage and condition recorded at the time of the order. Minor wear consistent with age and mileage is not a defect.
4. Prices and quotations
Prices are quoted in the currency shown and may change before an order is confirmed. A quotation is valid for the period stated in it, or for 7 days if no period is stated. Prices exclude import duties, taxes and destination charges unless expressly stated otherwise.
5. Orders and contract
An order becomes binding when we confirm it in writing (order confirmation or proforma invoice) and the deposit has been received. Vehicle availability is confirmed at that moment; if a vehicle has become unavailable, we will inform you promptly and refund any amount already paid.
6. Payment
We accept payment by bank transfer and by the payment methods shown at checkout, which may include major cards and online payment providers. The applicable methods are those displayed when you place your order. A deposit reserves the vehicle; the balance must be settled before loading. Bank charges are borne by the payer unless agreed otherwise.
7. Cancellation and refunds
You may cancel before the vehicle is loaded. If you cancel, we will refund amounts paid less any costs already incurred (for example inspection, transport to port, customs or documentation) and any deposit expressly stated as non-refundable. After loading, cancellation is not possible and the sale is final, except where the vehicle materially differs from the agreed description.
8. Delivery and risk
Delivery takes place according to the Incoterm agreed in the order (FOB or CIF). Risk passes as provided by that Incoterm. Transit times are estimates and are not guaranteed; delays by carriers or customs authorities are outside our control.
9. Inspection and claims
We recommend inspecting the vehicle before shipment and again at destination. Any claim regarding the vehicle's condition must be notified to us within 7 days of hand-over, with photographs and, where relevant, an independent report. Shipping damage must be reported to the carrier as described on the Delivery page.
10. Limitation of liability
To the extent permitted by law, our total liability in connection with an order is limited to the amount paid for that order. We are not liable for indirect or consequential loss, including loss of profit or loss of use. Nothing in these terms excludes liability that cannot be excluded by law, or the rights you have under mandatory consumer protection rules.
11. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural events, strikes, port closures, export or import restrictions, or changes in law.
12. Intellectual property
All content on this website is protected as described in our Legal Notice.
13. Personal data
We process personal data as described in our privacy policy, which forms part of these terms.
14. Changes to these terms
We may update these terms from time to time. The version applicable to your order is the one published at the time the order is placed.
15. Governing law and disputes
These terms are governed by the laws of the People's Republic of China. Disputes will first be addressed through good-faith negotiation; if no solution is found, they will be submitted to the competent courts at our place of business, without prejudice to mandatory consumer protection provisions.
